Further to a series of webinar/seminar on NEC held in the Hong Kong engineering construction industry in the past 12 months as summarized below:

 

  • 24 August 2022, “NEC Q&A Forum” by Mr Robert Gerrard;
  • 15 December 2022, “The Effective Collaborative Safety Leadership” by Dr Angel Li, Ir Victor Wu and Ir Tim Leung;
  • 13 May 2023, “Project Audit on NEC Contracts” by Mr Robert Gerrard; and
  • 19 May 2023, “NEC Case Update and It’s Development in HK” by Mr Alvin Ho, Mr Bernard Ang, and Miss Isabelle Chan

This talk is to be given by Ir Harrison Cheung and Ir Vincent Li, both being Registered Professional Civil Engineer as well as practising barrister in Hong Kong focusing on construction disputes; and Ir Tim Leung with his over 30 years of experience in civil infrastructure construction and design in the Hong Kong construction industry.

 

By switching to use the NEC form of contract in public works projects in lieu of the traditional form of General Conditions of Contract (“GCC”) which had been used by practitioners for many years, there is a need to abandon some of the old ideas developed through using the GCC and to adapt to the new approaches embedded in the NEC form.

 

To illustrate this point, the speakers will share and discuss with the audience some of the real life dispute cases handled by them in acting as the Dispute Resolution Advisors and NEC Specialist in some construction projects in Hong Kong (with specific details relating to the particular projects omitted for confidentiality reason).

 

It should be emphasised that whilst the analyses and views presented by the speakers on these dispute cases may have been accepted by the parties concerned, they have not been subject to test through court or arbitration proceedings. Any different views offered by the audience are welcome.
